“Got the Keys… But Do You Own the Property?”

Buying a home is one of the most important financial decisions most people make. However, many homebuyers are surprised to learn that taking possession of a property and becoming its legal owner are two separate events.

In many cases, buyers receive the keys to their apartment, start paying maintenance charges, move into the property, and assume that they are now the legal owners. Unfortunately, possession alone does not establish ownership rights under the law.

Understanding the difference between possession and registration can help protect your investment and prevent legal complications in the future.

What is Property Possession?

Possession refers to the physical handover of a property by the developer, seller, or previous owner to the buyer.

Typically, possession occurs when:

  • The buyer receives the keys to the property.
  • The buyer is allowed to occupy the premises.
  • The buyer can move in and begin using the property.
  • Maintenance responsibilities may start transferring to the buyer.

While possession allows you to physically occupy the property, it does not by itself create legal ownership.

Simply put:

Possession gives you control of the property. It does not automatically give you legal title.

What is Property Registration?

Property registration (commonly called “Registry”) is the legal process through which ownership of a property is formally transferred and recorded with the government.

In India, registration is governed by the Registration Act, 1908.

The process generally involves:

  • Execution of a Sale Deed or Conveyance Deed.
  • Payment of applicable Stamp Duty.
  • Payment of Registration Charges.
  • Registration before the Sub-Registrar of Assurances.
  • Recording the ownership transfer in government records.

Once registration is completed, the buyer obtains legally recognized ownership rights over the property.

Why the Difference Matters

Many property disputes arise because buyers fail to distinguish between possession and ownership.

If You Have Possession But No Registered Sale Deed

You may face several legal limitations:

  • Your ownership claim may not be fully established.
  • Selling the property may become difficult.
  • Financial institutions may refuse to recognize the property as collateral.
  • Future legal disputes can become more complicated.
  • Mutation and transfer of records may not be possible.

In practical terms, you may be occupying the property without having completed the legal transfer of ownership.

If You Have Registration but No Possession

The opposite situation can also occur.

In this case:

  • You are the legal owner of the property.
  • Your name appears in official ownership records.
  • However, you may not have physical access to the property.

This situation can arise in delayed projects, under-construction developments, or possession disputes.

What Should Homebuyers Do?

Before making any final payment or taking possession, buyers should ensure that:

✓ The Sale Deed has been properly executed.

✓ Applicable Stamp Duty and Registration Charges have been paid.

✓ Registration has been completed with the concerned Sub-Registrar.

✓ Possession is supported by the required occupancy-related approvals wherever applicable.

✓ All project approvals and disclosures have been verified.
